Justice Benke was a concurring justice (with Gilbert Nares and William Todd) in the published In Re Joseph D., Cal.App.4th 678 (1993) Which established interstate comity in "emergency" jusrisdicition cases falling under the UCCJA, as superceding the court's parens patriae to protect the child. As a result the child was forced to live underground in Mexico for over four years (where he remains as of this writing) According to a San Diego Union Tribune story ---www.artmeg.com/crptn/perj1.htm---by Anne Krueger, she endorses the practice of
withholding evidence and lying to jurors in  certain cases. She is targeted by the watchdog group JUDGE  WATCH, whose sole objective is judicial reform throught the removal of incompetent judges.
