Is it right and just for judges of an appeals court to deliberately mis-state facts and law of a case, in order to sanction, by an affirming decision, what is clearly a case of a district judge's nullification of a party's right to bring a suit in federal court? This happened in Williams vs. City of Los Angeles, CA 94-56250. It is painstakingly evident that, under due process for a T-VII action, a City employer cannot prevail by a mere offering that the employee deprived retired from his employment: with the employee having the opportunity to prove the proffered retirement as pre- textual.
