Judge Swager committed Judicial Malfeasance in June 1993, when he placed my mother in a LPS Conservatship, without my mother or any witness pursuant to Probate Code 1812 being present.  These witnesses 13 in number were never informed of the Conservatorship hearing as  prescribe by statue. Judge Swager still proceeded with the conservatorship hearing against
statue with no witnesses, or even the proposed conservatee present. There was no need for a conservatorship hearing due to a Durable power of Attorney signed in 1991. My brother and I had retained through the referral of the Contra Costa County Bar Association the legal representatation of Frank Bray, a Martinez Attorney, who told me and my brother he would file an action to quash the conservatorship hearing due to the number of children and siblings and the Durable Power of Attorney for Health Care.  Bray should still have a copy of this Advanced Directive and it was also mentioned in the Court Investigators Report. Judge Swager dismissed Bray, and proceeded to place my mother Mrs Gladys Heldris in to a Conservatorship which has lasted six years. Pursuant to Welfare and Institutions Code 5361, an LPS conservatorship automatically expires after 12 months. Even though Judge Swager proceed without the proposed Conservatee and without any witnesses, I was told by his court reporter, that there were no transcripts available when I tried to appeal this bogus conservatorship, and then I was told by the court reporter that the transcript was lost. I was arrested by Judge Swager, because I had not provided the deeds to my mother's home, when I went into his court room. I have also filed two writs of Habeas Corpus for my mother's illegal restraint in Santa Clara County Superior Court. These Habeas Corpuses were filed 14 months apart and then transferred by different Santa Clara County Judges to Contra Costa County Superior Court Against my objections where upon these Writs of Habeas Corpuses, filed 14 months apart became "lost", they just disappeared.
