Notice of Appeal

You commence an appeal by filing a notice of appeal with the court from which you are taking the appeal. Pursuant to Rules of Court 5 and 5.1, in state court, the notice of appeal may be combined with the notice to prepare the reporter's transcript, the notice designating the papers from the clerk's transcript and/or the notice of election to proceed by way of appendix.

Docketing Statements

Several of the California Courts of Appeal require the appellant to file a docketing statement upon commencement of the appeal. The Ninth Circuit requires submission of a Civil Appeals Docketing Statement.

Notice To Prepare Reporter's Transcript

In both federal and state court you must designate the portions of the oral proceedings that the court reporter should transcribe for your appeal.

Notices For Preparation of Documentary Record

The state procedure requires the appellant to select a method for including the necessary documents in the record on appeal, and to designate the documents to be included. (Appeals to the Ninth Circuit proceed on the basis of the entire District Court record; the parties file excerpts of record.)

Costs on Appeal

The prevailing party on appeal is generally entitled to costs, and in specifically authorized cases, attorneys fees. The Ninth Circuit provides a form (Form 10) for claiming costs with its decision, as specified in Circuit Rule 39-1. In state court, the prevailing party files a memorandum of costs with the lower court.
