Comments from Visitors to the Appellate Counsellor Home Page:
- Marvin Cobb (11/17/98)
- Justice Orville Armstrong is yet another coward and "good old boy" in the USC
Trojan Family. With a USC Law degree that's over 40 years old, Justice Armstrong
singlehandedly changed California law so that USC could "win" its case against
Marvin Cobb. Armstrong literally had to reverse himself and over 80 years of
consistent rulings by the California State Supreme Court, to deprive Cobb of his 1994 12-0
unanimous jury verdict award of $2.1 million for Breach of Contract. In his first opinion http://www.cae.wisc.edu/~dwilson/cobb/appeal2.html,
Justice Armstrong ruled that USC's post trial motions for JNOV and New Trial were
"premature and void" because they were filed before all of the issues of the
case had been finally decided. In the last opinion http://www.cae.wisc.edu/~dwilson/cobb/ApplDecide98.html,
Armstrong changed his mind and decided that USC could now prevail with those same void and
premature motions. Unlike his first opinion, Armstrong chose not to publish the
final edition, knowing he had changed the law just for one man. We are all very sorry that
Justice Armstrong was re-elected this year, very sorry.
