I recently argued a case in which Justice Gaut was on the panel. During the course of argument, Justice Gaut asked a question which was an issue in another case in a Riverside County trial court between the same parties, but which was not an issue in the case on appeal. The issue had not been briefed or argued and there was no reason for Justice Gaut to know it was an issue. I had the clear impression that Justice Gaut had discussed the case with the trial judge, or with one of his colleagues who is know to be friends with the trial judge.
